The role you're applying for is exempt from the Rehabilitation of Offenders Act 1974. This means the employer can obtain an Enhanced DBS certificate through the Disclosure and Barring Service, and may in certain circumstances include the Adult Barred List. Some old and minor convictions and cautions are "protected" (eligible for filtering) and do not need to be disclosed. Refer to current NACRO filtering guidance if you are unsure.

Barred List & DBS Update Service

Adult / Children's Barred List history and DBS Update Service registration

Being on the Adult Barred List makes it a criminal offence to work in regulated activity with adults.
The DBS Update Service costs £16 per year and lets employers check your certificate instantly. Highly recommended for care workers.

Confidentiality — your duty of care

As a member of the WellTrust team, you will have access to sensitive personal information about the people we support (service users), their families, colleagues, and the organisation. Confidentiality is a fundamental duty of care and a legal requirement under the Data Protection Act 2018, UK GDPR, the common-law duty of confidence, and the Care Act 2014.

What you must not share

You must not share confidential information about service users, staff, or WellTrust business with anyone who is not authorised to receive it. This includes:

  • Medical or health information (diagnoses, medications, mental health status)
  • Care plans, risk assessments, and daily notes
  • Personal circumstances (family, finances, address, immigration status)
  • Photographs, video, or audio recordings of service users or colleagues
  • Login credentials for care systems, rotas, or records
  • Any information about a service user shared on social media (even without naming them)

When information can be shared

Information may only be shared with people who have a legitimate need to know, such as other care staff on the person's care team, healthcare professionals, and where the law requires (e.g. safeguarding referrals, coroner requests, court orders). If in doubt, ask your manager before sharing.

After you leave

Confidentiality applies both during and after your employment with WellTrust. Even if you leave, you must never disclose information you learned in the course of your work.

Breaches

Breach of confidentiality is a disciplinary matter and may amount to gross misconduct, resulting in dismissal, potential referral to the DBS Barred List, and referral to professional regulators (NMC, HCPC, Social Work England). Deliberate or malicious breaches can also lead to criminal prosecution under Section 170 of the Data Protection Act 2018.
